If you were involved in a serious accident of any kind, such as a car crash, you may be experiencing a concussion or other head injury.  If you believe that your injuries were due to the negligence of another party, you might be asking the question, can I sue for a concussion?  The answer is yes.

What is Post-Concussion Syndrome?

While many people recover from a concussion within a few weeks of an accident, some head injuries are worse and can linger for a long time.  If you are experiencing symptoms of post-concussion syndrome, you may be entitled to added compensation when you settle a personal injury claim.

Some of the symptoms of post-concussion syndrome include:

  • Dizziness
  • Headaches
  • Tiredness
  • Anxiety
  • Depression
  • Mood changes.

If you are experiencing these symptoms after a car accident, you should go to your doctor and be tested for post-concussion syndrome.  If the physician diagnoses post-concussion syndrome, contact your concussion attorney right away to discuss your options.

What Causes Concussions in Car Accidents?

There are many ways a concussions can be suffered in a car accident.  The sheer force of the crash is the main reason, but there are other causes of concussions.  They include:

  • Airbags – One of the many safety features in your car can also cause you to sustain a concussion.  Airbags deploy very fast and hard, and you may get a concussion simply by being hit with the airbag.
  • Seatbelts – We wear seat belts to prevent severe injuries if we are in a car accident.  However, the great force exerted by the seatbelt in the event of a sudden stop can cause the brain to move back and forth within the skull and cause a concussion.
  • Hitting the steering wheel – While rare, the airbag in the steering wheel may not deploy at the time of the accident, and your head may move forward so quickly that it slams against the steering wheel, causing a concussion.
  • Ejection from the car – The force of the accident may be so severe that you are ejected from the car and suffer head injuries on impact with the ground or surroundings.  This is also common in motorcycle accidents as you do not have the car frame to protect you from being ejected.
  • Front windshield – If the point of impact is in such a way that your body moves up as well as out, you may be thrust into the front windshield, causing a concussion

How Do I Sue for a Concussion?

If you have suffered injuries due to the negligence of others, chances are you are pursuing a personal injury claim against them.  A claim for a concussion can be added to your current claim and your lawyer will negotiate with the insurance companies on your behalf.  If you think you have reached concussion injury lawsuit eligibility, you should gather as much information as possible about the accident and your sustained injuries.  It can sometimes be difficult to prove a claim for a concussion because you need to show that the accident itself caused your injury.  Some of the documents you have can assist your attorney in proving a concussion, such as . . .

  • All of your medical records, including any diagnostic tests that were run when you were seeking medical attention
  • A document from your physician stating that you have post-concussion syndrome and that it was caused by the accident
  • Written testimony from your friends, family, or work colleagues who can state that they have seen a decline in memory, concentration, or mood after the accident.

Other Events That Can Cause Concussions

While car accidents are the most common way a person can sustain a concussion, there are other types of events where you may have a head injury and may be able to file a claim against the negligent person or entity.

  • Work Injuries – People who work in dangerous jobs such as construction are apt to sustain an injury at work.  Falling debris, a slip and fall, or a faulty machine can cause a worker to get a concussion.  If you are injured at work and have been diagnosed with a concussion, you should be sure to include that in your claim with the workers’ compensation board.
  • Violent Crimes – If you have been a victim of a violent crime, such as a robbery or a mugging, you may have been thrown or pushed down and sustained a head injury.  You can start the process by suing the person who attacked you and seek damages for the concussion.
  • Other Personal Injury Claims – If you sustain a concussion after a slip and fall while on someone else’s property, you may be entitled to compensation for their negligence.

Compensation After a Concussion

If you have sustained a concussion because of someone’s negligence, you may be able to receive compensation.  You will need to prove that you were damaged due to that person’s actions.  If you are able to do that, you may be compensated for the following losses:

  • Medical expenses
  • Lost wages
  • Pain and suffering
  • Psychological and emotional trauma
  • PTSD
  • Lessening of your quality of life
  • Future lost earnings.
